Legacy Planning

Creating a plan whereby your legacy is protected in a manner that reflects your values and goals. We can help you ensure that your surviving spouse has adequate resources to support his or her needs. We can also help provide protection for non-traditional families or family members who are a part of a non-traditional relationship and protection for blended families – in each case, ensuring that a surviving spouse, as well as the children of each respective spouse, are adequately supported after the death of a testator.

Special Needs Planning

Many parents and grandparents do not wish to favor one child or grandchild over another in estate planning; however, when a family member is mentally incapacitated, disabled, suffering from dementia or has another medical condition which qualifies him or her to receive government benefits, creating a comprehensive Special Needs Plan for that child or grandchild may be necessary. Your plan may consist of legal tools including, but not limited to: initiating guardianship proceedings appointing someone to oversee the financial and physical care of the individual, execution of a Durable Power of Attorney and/or establishing a Special Needs Trust to ensure that your family member has the access to the inherited wealth, while maximizing government benefits.

Asset Protection Planning:

It is an unfortunate reality that we must devise a plan to protect our assets from frivolous litigation and other legal threats, such as divorce. These threats may also jeopardize the resources and income that you might leave to your family as part of your legacy. After a comprehensive review of your assets, your specific plan might include Prenuptial Agreements, Domestic Partnership Agreements and/or specifically tailored Trusts to protect your family’s assets.
